By accessing or using Kitipay mobile application and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

Eligibility

To use Kitipay, you must:

• Be at least 18 years of age
• Be a resident of Nigeria
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete registration information
• Comply with all applicable local, state, and federal laws

Account Registration and Security

Registration Requirements

You must create an account to use our services. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Using strong passwords and enabling security features

Services Provided

Kitipay provides the following services:

• Bill payments (airtime, data, TV subscriptions, electricity, betting wallets)
• Internal transfers between Kitipay users
• Digital wallet management
• Transaction history and reporting
• Customer support services

Fees and Charges

Certain services may be subject to fees and charges. We will clearly disclose all applicable fees before you complete a transaction. Fees are subject to change with prior notice to users.

• Internal transfers: Free of charge
• Bill payments: Service fees may apply
• Wallet funding: Processing fees may apply
• Other services: As disclosed at the time of transaction

Prohibited Activities

You agree not to:

• Use our services for any illegal or unauthorized purpose
• Engage in fraudulent activities or money laundering
• Violate any laws, regulations, or third-party rights
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our services
• Use automated systems or bots to access our services
• Impersonate any person or entity
• Share your account with others

Transaction Disputes and Refunds

If you believe a transaction was made in error or without authorization, you must notify us immediately. We will investigate all disputes in accordance with applicable laws.

Refund policies vary by transaction type and service provider. We will work to resolve disputes fairly and promptly.

Compliance and KYC

To comply with Nigerian financial regulations and anti-money laundering laws, we require:

• Identity verification (KYC) for all users
• Government-issued identification documents
• Bank Verification Number (BVN) verification
• Proof of address where applicable

We reserve the right to suspend or terminate accounts that fail to complete verification or comply with regulatory requirements.

Limitation of Liability

To the maximum extent permitted by law, Kitipay shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use our services.

We are not responsible for delays, failures, or interruptions caused by third-party service providers, network issues, or circumstances beyond our control.

Intellectual Property

All content, features, and functionality of Kitipay, including but not limited to text, graphics, logos, and software, are the exclusive property of Kitipay and are protected by copyright, trademark, and other intellectual property laws.

Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Service
• You engage in fraudulent or illegal activities
• Your account poses a security risk
• Required by law or regulatory authorities
• You fail to complete KYC verification

You may close your account at any time by contacting our support team. Any remaining balance will be returned according to our withdrawal policies.

Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes via email or in-app notification. Your continued use of our services after such changes constitutes acceptance of the modified terms.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of Nigerian courts.
